DON’T PAY ANY MONEY UP FRONT TO APPEAL
BEEN DENIED ERISA BENEFITS?
If your ERISA claim for disability benefits has been denied by an insurance company administering your claim, although not necessary, it is in your best interest to hire an attorney to help you, but DO NOT pay any money up front for any assistance.
The work to get a person’s disability benefits reinstated is not easy. Most administrative records (fancy way of saying your claim file) are hundreds if not thousands of pages that need to be reviewed very very carefully. Most companies or firms do not take the time to find where the insurance company made a mistake, misrepresented information, simply didn’t use information that doesn’t help them; and their favorite trick of cherry picking the best information to suit whatever decision they want to make. This is just part of the process of things that need to be done to help a person get their disability benefits reinstated.
There are companies and firms that will help you prepare your appeal letter for thousands of dollars up front. They will show you examples of appeals 50 to 100 pages long scaring your by saying your missing a lot of things and if you don’t do certain things, you will not get approved etc… They will show you previous appeals and samples with numerous cases explaining the law, summary of the person’s life, why their recovery is hampered or unlikely to get better, claim bad faith stating that the insurance company did not fully and fairly review your claim and more.
The problem with this type of appeal is that it does NOTHING to help you get reinstated and does NOTHING to help support your claim if you have to go to litigation.
